Dumping solid waste against a school wall is not a private nuisance only. It engages the Solid Waste Management Rules, 2016, the Air and Water Acts where odour and leachate are made out, and the National Green Tribunal Act, 2010, where a substantial environmental question is raised.
An original application before the Principal Bench is built on: dated photographs, complaints to the municipal corporation and the pollution control committee, any prior orders, and a clear prayer — removal, compensation, personal appearance of officers, a timeline.
Courts and Tribunals do not move on outrage. They move on a record that a statutory duty was breached and that the breach continues.
